**COMMUNICATION AUX ÉCOLES DE CONDUITE MOTO**
Bulletin #10-2018 : Clarification de l’AQTr - Formulaire relatif aux conditions d’utilisation d’un terrain
L’AQTr a récemment entamé auprès des écoles de conduite de classe 6, la révision administrative de la conformité des terrains moto utilisés par celles-ci. Puisque certains dossiers-écoles ne détiennent pas toutes les informations requises, l'AQTr doit procéder à une mise à jour desdits dossiers, et demande aux écoles concernées de compléter et de signer le Formulaire relatif aux conditions d’utilisation d’un terrain, et ce, en vertu de l’article 4.86 des Exigences détaillées.
Compte tenu des questionnements des écoles à propos de ce formulaire, ce bulletin vise à clarifier son utilité.
Tout d'abord, les évaluations des terrains moto pour certaines écoles remontent à plusieurs années, soit à 2012 à l’époque où la SAAQ demandait à l’AQTr de procéder à des évaluations administratives bisannuelles. Depuis, certains terrains peuvent avoir connu des modifications (ex. construction d’un nouvel édifice/de terrepleins, asphalte enlevé, etc.). De plus, il s’avère que certaines écoles ont omis d’informer l’AQTr de modifications apportées aux terrains qu’elles utilisent. Enfin, certaines ententes ne font pas mention, par exemple, de la superficie du terrain attribuée à l’école de conduite ou de toute autre information pertinente concernant l’usage du terrain.
Dès lors, l’AQTr voit la nécessité d’actualiser les informations des terrains au dossier des écoles, et s’en remet à la bonne foi des écoles de conduite en leur demandant de remplir conjointement avec le propriétaire du terrain ledit formulaire. Ceci permet ainsi à l’AQTr de faire les contrôles requis afin de s’assurer que les conditions de location du terrain demeurent les mêmes et que le terrain est toujours conforme à l’article 2.14 des Exigences.
**Il est à noter qu’il ne sera pas demandé aux écoles de remplir ce formulaire annuellement. En effet, le formulaire devra être rempli seulement si les conditions d’usage du terrain sont modifiées lors du renouvellement par l’école du bail de location.
Enfin, l’AQTr tient à préciser qu’il n’y a aucun lien à faire entre les vérifications qui sont effectuées actuellement sur les terrains motos par l’AQTr et la demande de remplir le Formulaire relatif aux conditions d’utilisation d’un terrain.

**COMMUNICATION TO CLASS 6 DRIVING SCHOOLS**
News Bulletin #10-2018: Clarification from the AQTr - Form related to the track usage conditions
The AQTr has recently started some verification about the compliance of class 6 driving schools closed-circuit tracks. Since some information was missing in a few driving schools’ files, the AQTr has to update the files of these schools. Thus, in virtue of the article 4.86 of the Detailed Requirements, the AQTr asks the affected driving schools to fill in and sign the following form: "Form related to the track usage conditions".
Since the AQTr has received a few questions about this form, this news bulletin aims to clarify the use of the document.
Indeed, the last assessment of some driving schools’ closed-circuit track dates back to a few years ago, i.e. to 2012 at the time of the biennial administrative assessments which were required by the SAAQ. However, closed-circuit tracks might have been modified since then (e.g.: construction of a new building/ central reservations, asphalt removal, etc.). Also, a few driving schools forgot to inform the AQTr about the changes that were brought to their closed-circuit tracks. Moreover, some renewal use agreements do not mention the surface area for instance or any other relevant information related to the use of the track.
For all these reasons, it is necessary for the AQTr to update the information of the closed-circuit tracks that is in driving schools’ files. The AQTr thus relies on the good faith of driving schools by asking them to fill in the aforesaid form together with the owner of the closed-circuit track; this will enable the AQTr to do the required verifications to make sure that the rental conditions of the track remain the same and that the track still complies with the article 2.14 of the Requirements.
**Please note that the AQTr will not ask the schools to fill in this form every year, but only if some changes occur when the school renews the rental agreement.
The AQTr would like to add that the request to fill in the dedicated form is not related to the verifications that are currently being made about closed-circuit tracks.
