Le présent bulletin porte sur l’utilisation des documents et du matériel produits par la Société de l’assurance automobile du Québec (SAAQ), lesquels doivent être utilisés dans le cadre des formations à la conduite et plus particulièrement, sur le Carnet d’accès à la route (Carnet).
Au cours des dernières années, la SAAQ a dû faire face à un nombre grandissant de doléances portant sur de supposées disparités entre les informations présentées dans les documents et le matériel utilisé dans les formations à la conduite et celles sur lesquelles reposent les examens théoriques et pratiques.
Pour éliminer ces situations, la SAAQ souhaite donc s’assurer qu’il n’existe aucune confusion quant aux contenus qu’elle développe.
En conséquence, la SAAQ adopte l’orientation suivante à l’égard du Carnet :

Les logos du Programme d’éducation à la sécurité routière (PESR) et de la SAAQ ne pourront dorénavant être apposés que sur la version intégrale du Carnet.

Les logos du PESR et de la SAAQ ne pourront être apposés si des modifications ont été apportées aux contenus ou à la présentation du Carnet.
Les groupements d’écoles de conduite pourront donc utiliser les copies dont ils disposent actuellement, et ce, jusqu’à épuisement des stocks.
Lors de la réimpression de leur document respectif, si les groupements ont apporté des modifications au Carnet, les logos du PESR et de la SAAQ devront être retirés.
La SAAQ tient également à rappeler la mention apparaissant dans le Carnet :
« Toute reproduction ou communication de ce document, en tout ou en partie et sous quelque forme que ce soit, est permise dans la mesure où la source en est précisée. Le contenu de ce document ne peut être modifié par addition, par suppression ou autrement sans porter atteinte aux droits de la Société de l’assurance automobile du Québec. »
Dans la mesure où des modifications sont apportées au contenu du Carnet, les règles relatives à la propriété intellectuelle doivent donc être respectées.
Ainsi, tout extrait du contenu du Carnet doit donc être accompagné d’une citation référant au document original.
News Bulletin #16 – 2017: Message from the SAAQ - Direction with Regard to Documents and Teaching Material
The present news bulletin focuses on the use of documents and teaching material produced by the Société de l’assurance automobile du Québec (SAAQ), which have to be used during the trainings, and more precisely on the Road Access Binder (Binder).
During the last couple of years, the SAAQ had to face an increasing number of complaints on the alleged differences between the information contained in the documents / teaching material used during Road Safety Education Program trainings and the information that was asked during theoretical and practical exams.
In order to find a solution to that, the SAAQ would like to make sure that there is no confusion about the contents that are developed.
Thus, the SAAQ has taken the following direction with regard to Road Access Binders:

The logo of the Road Safety Education Program (RSEP) and of the SAAQ will no longer be allowed on the original version of the Binder.

The logo of the Road Safety Education Program (RSEP) and of the SAAQ will no longer be allowed on Binders if its contents or presentation was/were modified.
The SAAQ authorises groups of driving schools to use their own version of the Binder, while stocks last.
At the moment of reprinting their version of the Binder, the groups of driving schools, which brought changes to the Binder, will have to remove both the RESP and the SAAQ logos.
Also, the SAAQ would like to remind driving schools of the following note from the Binder:
“Any reproduction or communication of this document, may it be entirely or partly and in any form whatsoever, is authorised as long as the source is cited. The modification of this document contents, by any addition or suppression process, might not be done without the infringement of the Société de l’assurance automobile du Québec rights.”
Indeed, if modifications are made to the contents of the Binder, intellectual property rights should be respected.
Thus, any extract from the Binder must be quoted and refer to the original document.
